Quail Hunting Florida SMS Terms and Conditions

1. Age Restriction & Verification

This Service is intended only for individuals 21 years of age or older. By opting in, you affirm that you are 21+, and we reserve the right to require verification of age at any time.

This program involves communications related to hunting activities, firearm-related safety protocols, and preserve operations.

 

2. Program Description & Consent

By opting into the Quail Hunting Florida messaging program, you confirm that you are the current subscriber or authorized user of the mobile number you provided.

You consent to receive recurring automated text messages (SMS/MMS) from Quail Hunting Florida. Msg frequency varies (up to 4 promotional Msgs/Month). Msg & Data rates may apply.

Messages may be sent using an automatic telephone dialing system (autodialer), which may include: Booking confirmations, Event reminders and invitations, Safety alerts and operational notices, Preserve updates and announcements, and Occasional promotional offers.

Message frequency: You can expect to receive up to 4 promotional messages per month. Transactional messages, such as booking confirmations and event reminders, do not count against this limit.

Your consent to receive messages is not a condition of purchase, booking, membership, or participation.

3. Costs

Message and data rates may apply depending on your mobile plan.

 

4. Opt-Out Instructions

You may cancel SMS communications at any time.

Reply STOP to opt out. You may also opt out by replying: END, CANCEL, QUIT, or UNSUBSCRIBE. You may also request to be opted-out by emailing info@quailhuntingflorida.com with the subject line “SMS OPT-OUT” and providing the mobile number you wish to remove.

Once processed, you will receive a single confirmation message and will no longer receive SMS alerts. Please allow up to 72 hours for complete processing of your removal request.

To rejoin, you must complete the original age-gated opt-in process.

Mobile carriers (including AT&T, Verizon, T-Mobile, and others) are not liable for delayed, undelivered, or misdirected messages.

We do not share, sell, or transfer your mobile number to third parties for their own marketing purposes. We will not share your text messaging originator opt-in data (such as consent and phone number) with any third parties, except for the necessary data required solely to facilitate the SMS service.

Mobile number and age-verification data are retained only as long as necessary to operate the messaging program.

Data will be deleted upon request or account cancellation unless otherwise required by law.

This messaging program does not promote or facilitate firearm sales.

Communication relates to marketing, preserve operations, events, guided hunts, on-site training, and safety protocols. By participating in this service, you acknowledge and agree that you are solely responsible for adhering to all applicable local, state, and federal laws regarding the possession, handling, and use of firearms.

12. Dispute Resolution and Agreement to Arbitrate

Any dispute or claim relating in any way to your use of the Service or these Terms will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement. There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages) and must follow the terms of these Conditions as a court would. We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action.

 

13. Governing Law

These Terms and Conditions and the relationship between you and Quail Hunting Florida shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions.
